1. Agreement to Terms

By accessing or using ModaLink ("the Service"), operated at modalink.co.tz and through our mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ModaLink is a fashion marketplace that connects customers with fashion designers in Tanzania. We provide a platform for designers to showcase their portfolios and for customers to discover, browse, and contact designers directly. ModaLink does not facilitate payments between customers and designers — all transactions occur directly between the parties.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to use the Service.
  • One person may not maintain more than one account.
  • You are responsible for all activity that occurs under your account.

4. Designer Accounts

If you register as a designer, you additionally agree that:

  • All designs you upload are your own original work or you have proper rights to display them.
  • Your profile information (brand name, location, specialties) is accurate and not misleading.
  • You will respond to customer inquiries in a professional and timely manner.
  • You will not use the platform to sell counterfeit or infringing goods.
  • Price ranges displayed on your designs are honest and indicative of actual pricing.

5. Customer Accounts

If you register as a customer, you agree that:

  • You will use the platform respectfully and not harass designers.
  • Reviews you leave are honest and based on genuine interactions.
  • You will not misuse designer contact information for spam or unsolicited marketing.

6. Acceptable Use

You agree NOT to:

  • Upload content that is illegal, harmful, threatening, abusive, or discriminatory.
  • Impersonate another person or entity.
  • Use automated systems (bots, scrapers) to access the Service.
  • Attempt to gain unauthorized access to other users' accounts.
  • Upload malware, viruses, or any harmful code.
  • Use the Service for any purpose that violates Tanzanian law.
  • Scrape or bulk-download designer portfolios or contact information.

7. Content Ownership

  • Your content: You retain ownership of all content you upload (designs, photos, text). By uploading, you grant ModaLink a non-exclusive license to display and distribute your content on the platform.
  • Our content: The ModaLink name, logo, and platform design are our intellectual property.
  • Removal: You can delete your content at any time. We may also remove content that violates these terms.

8. Reviews and Ratings

  • Reviews must be honest and based on real interactions with a designer.
  • Fake reviews, paid reviews, or review manipulation is prohibited.
  • We reserve the right to remove reviews that violate these terms.
  • Designers may not retaliate against customers for negative reviews.

9. Transactions Between Users

ModaLink is a discovery and connection platform. We do not process payments, guarantee work quality, or mediate disputes between customers and designers. Any agreements, payments, or transactions are solely between the customer and designer. We encourage users to communicate clearly about pricing, timelines, and expectations before beginning work.

10. Limitation of Liability

ModaLink is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Service, including but not limited to disputes with designers/customers, loss of data, or service interruptions. Our total liability shall not exceed the amount you have paid us (if any) in the past 12 months.

11. Account Termination

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion. You may delete your account at any time by contacting us.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.
